公共资助学术出版物的二次出版权问题研究——以欧盟最新立法趋势为鉴

摘要：在开放存取模式的背景下，是否需要为公共资助学术出版物的作者增设二次出版权成为了学界与实务届的 焦点。为了促进科研成果的传播与共享，保障公民研究权的实现，德国、法国等多个欧盟成员国对版权法进行了 修改，但也引发了部分出版商与学界的反对。就我国目前情况而言，通过对我国学术出版业现状、现有规制手段 以及立法必要性进行综合考量，我国目前有必要在版权法中引进二次出版权。
